El régimen jurídico de las islas en el derecho internacional
una interpretación del artículo 121 de la CONVEMAR

La Convención de las Naciones Unidas sobre el Derecho del Mar de 1982, estableció en el artículo 121 el régimen jurídico de las islas. Los párrafos 1 y 2 del artículo 121 son parte del derecho internacional consuetudinario, debido a que reiteran lo dicho por la Convención de Ginebra de 1958 sobre el Mar Territorial y la Zona Contigua, pero el párrafo 3 del artículo 121 introdujo una nueva diferenciación entre islas y rocas. Acorde al párrafo 3, las rocas no producirán todos los espacios marítimos, con la excepción del mar territorial y la zona contigua. Ello, implica una restricción a los Estados con territorios insulares en la extensión de sus reclamaciones de espacios marítimos, incluyendo la zona económica exclusiva, la plataforma continental y la plataforma continental extendida. Este artículo, busca analizar el artículo 121, en especial la diferencia entre islas y rocas, el aporte de la jurisprudencia en la materia y sus implicancias en el derecho internacional.
