Abstract

The present issue stresses the increasing importance of the effective protection of the essential rights of the people and how this affect the family relations, showing how the personal duty’s breaches between the members of the family, specifically the parent’s duties that could affect the right to identity, and for the severity could affect basic rights, raise the possibility to claim at the Civil Court the torts that could lead, related with the constitutional principles of the Chilean law. Trying to repair the family torts, Álvarez in the issue, determinate the legal system and the requirements according to the Chilean law. However, there is the question whether the tort’s repair principle would be totally accepted or only in a part.
