How to Cite
Abstract
The methodological and normative foundations of the economic analysis of law are critically addressed, sets forth its main challenges and presents some preliminary assessments. In particular, the model of rational choice, the proposal of value neutrality, the concept of efficiency, and the reasons that could justify the use of efficiency as a social policy guide are discussed in the article. Thus, it’s possible to realize that economic analysis of law provides a new research program with its theoretical framework, methodology and analytical tools.
